1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of the eSIMFly website, applications, and services (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of the Terms, you must not access or use the Service.

The Service is operated by eSIMFly, with a registered address at EK DIGITAL S.L. 191 Calle Clot, Barcelona, 08027, Spain ("eSIMFly", "we", "us", or "our"). These Terms apply to all visitors, registered users, and customers.

2. Description of the Service

eSIMFly provides digital eSIM products that enable mobile data connectivity in supported destinations. Our services include, but are not limited to:

  • Offering and delivering eSIM data plans for various countries and regions
  • Providing installation and activation instructions
  • Enabling account access, order history, and service management
  • Offering customer support related to eSIM activation, usage, and troubleshooting

eSIMFly does not operate physical mobile networks. Connectivity is provided through partner network operators in each destination.

3. Eligibility and Account Registration

To purchase eSIM products, you must create an account and confirm that you:

  • Are at least 18 years old
  • Provide accurate, current, and complete registration information
  • Maintain the confidentiality of your login credentials
  • Accept responsibility for all activity that occurs under your account

You agree to notify us promptly if you suspect unauthorized access or use of your account.

4. Purchases, Pricing, and Payment

When purchasing an eSIM through the Service:

  • Prices are displayed in USD, unless stated otherwise
  • Applicable taxes or fees may be included or added at checkout
  • Payments are processed securely through third-party payment providers
  • eSIM delivery is typically instant upon successful payment

You are solely responsible for reviewing product details, plan limitations, and device compatibility before completing a purchase.

5. eSIM Delivery, Installation, and Activation

After purchase, you will receive access to:

  • A QR code for eSIM installation
  • An activation code for manual installation (where applicable)
  • Instructions for installation and activation

Once an eSIM is installed or activated, it cannot be transferred, resold, or reused on another device. Data plans are subject to the validity period, geographic coverage, and data limits specified at the time of purchase. Unused data does not roll over after expiration.

6. Device Compatibility and User Responsibility

eSIM functionality requires a compatible and unlocked device. Before purchasing, you are responsible for ensuring that your device:

  • Supports eSIM technology
  • Is not restricted by a carrier lock
  • Is compatible with the selected destination and network requirements

eSIMFly is not responsible for activation or connectivity issues resulting from device incompatibility or unsupported devices.

7. Network Performance and Limitations

Mobile data services depend on local network operators, coverage, infrastructure, and environmental conditions. As a result:

  • Coverage quality and data speeds may vary by location
  • Uninterrupted connectivity is not guaranteed
  • Temporary outages or reduced performance may occur

eSIMFly does not guarantee specific network speeds, latency, or continuous availability of service.

8. Fair Use and Prohibited Activities

You agree not to use the Service:

  • For unlawful, fraudulent, or abusive purposes
  • In violation of applicable laws or regulations
  • To interfere with or disrupt network operations
  • To transmit malicious software or harmful code
  • To resell, redistribute, or commercially exploit eSIM products without authorization

We reserve the right to suspend or terminate accounts that violate these Terms.

9. Intellectual Property

All content, software, trademarks, logos, and materials available through the Service are owned by or licensed to eSIMFly and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written permission.

10. Suspension and Termination

We may suspend or terminate access to the Service, with or without notice, if:

  • These Terms are violated
  • Fraudulent, abusive, or suspicious activity is detected
  • Required by law or regulatory authorities

Termination does not affect rights or obligations that accrued prior to termination.

11. Limitation of Liability

To the maximum extent permitted by law, eSIMFly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to:

  • Your use or inability to use the Service
  • Network coverage limitations or connectivity issues
  • Device incompatibility
  • Unauthorized access to your account
  • Actions or omissions of third-party service providers

Our total liability for any claim shall not exceed the amount paid for the affected eSIM product.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Refunds and Cancellations

Refunds are governed by our Refund Policy, which forms part of these Terms. By purchasing an eSIM, you acknowledge that refunds are subject to specific conditions due to the digital nature of the product.

14. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised "Last updated" date.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which eSIMFly is registered, without regard to conflict of law principles.
